Terms of Service

1.1 Marketplace Intermediary Status

OpenHouzz operates purely as an online technology platform and information-matching intermediary. We provide interactive 3D spatial planning software tools and project matching services connecting homeowners with independent third-party interior design firms, contractors, architects, and home improvement service providers (collectively, "Merchants" or "Designers").

1.2 Exclusion of Renovation Contracts

OpenHouzz is not an interior design firm, general contractor, building surveyor, or agent for any Merchant or Homeowner.

• Any conversation, quotation, design consultation, scope of work, warranty, or renovation agreement entered into is strictly a bilateral contract between You and the selected Merchant.
• OpenHouzz is not a party to, nor is it bound by or responsible for, any terms, pricing, delays, defective workmanship, cost overruns, or disputes arising from your engagement with any Merchant.

1.3 No Guarantee or Endorsement

While OpenHouzz screens Merchants for ACRA registration and basic accreditation standards, we do not endorse, guarantee, or certify the performance, solvency, or final work quality of any Merchant. You are solely responsible for conducting your own due diligence, checking HDB/CaseTrust registrations, and vetting renovation contracts before making payments.

2.1 Eligibility Criteria

To use our 3D layout canvas, export floor plan blueprints, or request quotes, you represent and warrant that:

• You are at least eighteen (18) years of age;
• You possess the legal capacity to enter into binding agreements under Singapore law;
• You are the lawful legal owner, prospective purchaser holding a valid Option to Purchase (OTP), or authorized tenant of the property floor plan submitted.

2.2 WhatsApp OTP Phone Verification Gate

• Access to quote requests and high-resolution spatial exports requires mandatory WhatsApp One-Time Password (OTP) verification.
• You agree to provide true, current, and accurate contact details. Submitting fake, temporary, invalid, or third-party phone numbers is a breach of these Terms and will result in immediate termination of account access and deletion of your saved 3D layout projects.

2.3 Capped Matching Guarantee

When you verify your project request via WhatsApp OTP, OpenHouzz transmits your spatial layout, property scope, and budget preferences to a strict maximum of five (5) matched Merchants. We explicitly restrict broadcast volume to protect you from overwhelming spam calls or aggressive sales harassment.

3.1 Visualization Purposes Only

All 2D blueprints, 3D renderings, furniture scaling tools, wall-hacking visualizers, and spatial layouts generated via our embedded software (including third-party tools) are provided strictly for conceptual visualization purposes.

3.2 Structural & Regulatory Disclaimer

• Renderings generated on OpenHouzz do not constitute professional architectural, structural engineering, or mechanical/electrical (M&E) plans.
• You and your engaged Merchant are strictly required to independently verify load-bearing wall restrictions, HDB/BCA structural guidelines, ceiling heights, electrical trunking, and plumbing positions with accredited authorities or Professional Engineers (PE) prior to physical hacking or construction.
• OpenHouzz bears zero liability for structural damages or statutory fines incurred due to reliance on spatial mockups created on the Platform.

4.1 Ownership of User Content

You retain ownership of any text, property details, mood boards, photos, or floor plan modifications you upload or create on the Platform ("User Content").

4.2 Promotional License & Watermarking

By uploading or creating User Content on OpenHouzz, you grant us a worldwide, non-exclusive, royalty-free, perpetual, irrevocable license to use, host, reproduce, modify, display, and distribute such visual media for platform enhancement, social media features, and marketing campaigns. You explicitly grant OpenHouzz the right to apply its promotional watermark (Designed on OpenHouzz.com) to exported 2D/3D floor plan graphics and rendered media files.

4.3 Merchant Reviews & Testimonials

If you submit a review or rating regarding a Merchant on OpenHouzz, you warrant that:

• The review is based on your direct, first-hand experience with that Merchant;
• The information is truthful, accurate, and submitted in good faith;
• You are not an employee, family member, or competitor of the Merchant being reviewed.

OpenHouzz reserves the right to remove or edit any review that violates defamation laws, contains obscene language, or fails verification tests.

You agree not to engage in any of the following prohibited activities:

1. System Misuse: Attempting to reverse engineer, scrape, crawl, hack, or overload our 3D layout engine, database schemas, or API endpoints.
2. Fraudulent Projects: Submitting fictitious property addresses, fake budgets, or false project timelines to test or monitor Merchant behavior.
3. Commercial Exploitation: Re-selling, white-labeling, or commercially exploiting our 3D layout software, templates, or floor plan databases without prior written authorization from OpenHouzz.
4. Defamatory / Unlawful Posts: Uploading content that is illegal, defamatory, harassing, or infringes upon third-party copyright or privacy rights.

All software, code, UI design elements, visual tools, branding, domain names, logos, and proprietary floor plan databases on the Platform are the sole intellectual property of OpenHouzz Pte. Ltd. or its licensors. Except for the personal, non-commercial right to plan your residential unit, nothing in these Terms grants you any right, title, or interest in our intellectual property.

7.1 "As-Is" Service Provision

The Platform, 3D visualization canvas, and matching services are provided on an "AS IS" and "AS AVAILABLE" basis without warranties of any kind, whether express, implied, or statutory.

7.2 Cap on Monetary Liability

To the maximum extent permitted under Singapore law (including the Consumer Protection (Fair Trading) Act):

• OpenHouzz, its directors, employees, and agents shall not be liable for any indirect, consequential, special, or punitive damages, nor for any loss of renovation deposits, project delays, property damage, or contractual default caused by any Merchant.
• In any event, OpenHouzz's total aggregate liability to you for all claims arising out of or relating to the use of the Platform shall be strictly limited to S$100.00.

7.3 Indemnification

You agree to indemnify, defend, and hold harmless OpenHouzz Pte. Ltd. from any claims, liabilities, losses, damages, or legal expenses (including solicitor fees) arising from your breach of these Terms, your misuse of the Platform, or your contractual disputes with any third-party Merchant.

OpenHouzz reserves the right, in its sole discretion and without prior notice, to suspend or terminate your account access or delete your saved 3D floor plan projects if we determine that you have violated these Terms, provided unverified contact details, or engaged in fraudulent activity.

These Terms shall be governed by, construed, and enforced in accordance with the laws of the Republic of Singapore. Any dispute arising out of or in connection with these Terms or your use of the Platform shall be submitted to the exclusive jurisdiction of the Courts of the Republic of Singapore (including the Small Claims Tribunals where applicable).
